Fyxify App Long-Form Privacy Policy

NOTE: THIS APPLICATION IS INTENDED ONLY FOR USE BY INDIVIDUALS WITHIN THE UNITED STATES.  IF YOU ARE NOT LOCATED WITHIN THE UNITED STATES, PLEASE REFRAIN FROM SENDING ANY PERSONAL INFORMATION UNTIL YOU ARE LOCATED WITHIN THE UNITED STATES.

I.Introduction

fyxify, LLC, a Florida limited liability company ("fyxify "), respects your privacy and is committed to protecting it through fyxify’s compliance with this policy. This policy describes:

  the types of information that fyxify may collect or that you may provide when you purchase, download, install, register with, access, or use the Fyxify mobile application (this "App"); and

  fyxify’s practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies only to information fyxify collects in this App.

This policy DOES NOT apply to information that:

  fyxify collects offline or on any other fyxify apps or websites, including fyxify’s or third-parties’ websites you may access through this App; or

  you provide to or is collected by any third party (see “Third Party Information Collection”).

fyxify’s websites and apps and these other third parties may have their own privacy policies, which fyxify encourages you to read before providing information on or through them.

Please read this policy carefully to understand fyxify’s policies and practices regarding your information and how it will be treated. If you do not agree with fyxify’s policies and practices, do not download, register with, or use this App. By downloading, registering with, or using this App, you agree to this privacy policy. This policy may change from time to time (see “Changes to fyxify’s Privacy Policy”). Your continued use of this App after fyxify revises this policy means you accept those changes, so please check the policy periodically for updates.

II.Children Under the Age of 16

This App is not intended for children under 16 years of age.  No one under age 16 may provide any information to or on this App.  Fyxify  does not knowingly collect Personal Information from children under 16. If you are under 16, do not use or provide any information on this App or on or through any of its features, make any purchases through this App, use any of the interactive or public comment features of this App, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If fyxify learns it has collected or received Personal Information from a child under 16 without verification of parental consent, fyxify will delete that information. If you believe fyxify might have any information from or about a child under 16, please contact fyxify at (855) 403-8810.

III.Information fyxify Collects and How fyxify Collects It

fyxify may collect information from and about users of this App:

These third parties may also include:

These third parties may collect, receive, use, store, or transmit information you provide within this App or use cookies (alone or in conjunction with web beacons) or other tracking technologies to collect information about you, including information about your use of this App; information associated with your Personal Information; or information, including Personal Information, about your online activities over time and across different websites, apps, and other online services websites.  They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

fyxify does not control third parties or how they collect, receive, use, store, or transmit your information. For more information on third-party practices, please refer to such third parties’ applicable privacy policies, terms of use, end user license agreements, or similar disclosures, which may be available from the applicable mobile application store or by contacting the third party for more information.  If you have any questions, you should contact the responsible provider directly.

  Do Not Track” Requests

Some operating systems include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your activities monitored and collected.  No uniform technology standard for recognizing and implementing DNT signals has been finalized. Furthermore, we do not track users over time and across third party websites to provide targeted advertising. As such, this Application does not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.  However, some third-party service providers may keep track of your activities when they serve you content, which enables them to tailor what they present to you.  To determine whether a particular third party honors DNT requests, please read their privacy policies or contact the third party directly.  For more information about third parties that may collect information through this App, see “Third Party Information Collection”.  For more information about “do not track,” visit www.allaboutdnt.org.  

IV. How fyxify Uses Your Information

fyxify may use information that it collects about you or that you provide to it, including any Personal Information, to:

  provide you with this App and its contents and any other information that you request from fyxify;

  give you notices about your account, including expiration and renewal notices;

  carry out fyxify’s obligations and enforce fyxify’s rights arising from any contracts entered into between you and fyxify, including this App’s End User License Agreement and for billing and collection;

  notify you when App updates are available and of changes to any products or services fyxify offers or provides through it;

  in any other way we may describe when you provide the information; and

  for any other purpose with your consent.

The usage and device information fyxify collects may help it to improve this App and to deliver a better and more personalized experience by enabling fyxify to:

  store information about your preferences, allowing fyxify to customize this App according to your individual interests;

Location information is used to allow the user to navigate to a requesting customer and to track the user’s progress to the requesting customer’s location.

fyxify may disclose aggregated information about this App’s users and information that does not identify any individual or device without restriction.

In addition, fyxify may disclose Personal Information that it collects or you provide:

  to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of fyxify’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by fyxify about App users is among the assets transferred;

fyxify may also disclose your personal information:

VI.Your Choices About fyxify’s Collection, Use, and Disclosure of Your Information

fyxify strives to provide you with choices regarding the Personal Information you provide to fyxify. This section describes mechanisms fyxify provides for you to control certain uses and disclosures of your information.

  Tracking Technologies. You can set your browser to refuse all or some browser cookies or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of this App may then be inaccessible or not function properly.

  Promotional Offers from fyxify. If you do not wish to have your contact information used by fyxify to promote our own or third parties' products or services, you can opt-out by logging into this App and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes. If we have sent you a promotional email, you may also click “unsubscribe” at the bottom of the email. This opt out does not apply to information provided to fyxify as a result of a product purchase, warranty registration, product service experience, or other transactions.

fyxify does not control third parties' collection, receipt, use, storage, or transmission of your information. However, these third parties may provide you with ways to choose not to have your information collected or used in certain ways. You can opt out of receiving targeted ads from members of the Network Advertising Initiative ("NAI") on the NAI's website, which is currently located at https://optout.networkadvertising.org/?c=1#!/.  For more information about third-party services, see “Third Party Information Collection”.

VIII.Your California Privacy Rights

If you are a California resident, California law may provide you with additional rights regarding our use of your personal information.

California’s “Shine the Light” law (Civil Code Section 1798.83) may permit users of this App that are California residents to request certain information regarding fyxify’s disclosure of Personal Information to third parties for their direct marketing purposes.

IX.Data Security

fyxify has implemented reasonable measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure.  Any payment transactions will be encrypted.

The safety and security of your information also depends on you. Where fyxify has given you (or where you have chosen) a password for access to certain parts of this App, you are responsible for keeping this password confidential. fyxify asks you not to share your password with anyone.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although fyxify has implemented reasonable measures to protect your Personal Information, it cannot guarantee the security of your Personal Information transmitted through this App. Any transmission of Personal Information is at your own risk. fyxify is not responsible for circumvention of any privacy settings or security measures fyxify provides.

X.Changes to fyxify’s Privacy Policy

fyxify may update its privacy policy from time to time. If fyxify makes material changes to how it treats users' Personal Information, it will post the new privacy policy and either notify you at the email address specified in your account or include an in-App alert the first time you use this App after fyxify makes the change.

The date the privacy policy was last revised is identified at the top of the page. You are responsible for ensuring fyxify has an up-to-date active and deliverable email address for you and for periodically visiting this privacy policy to check for any changes.
